Terms of sale
These terms apply when you buy anything on 4044method.com. The seller is Colas Taylor, trading as 40 44 Method ("we", "us"), a sole trader based in England. To reach us, email train@4044method.com. By paying you agree to these terms, so please read them, along with the health and safety notice below.
Who can buy
You must be 18 or over and buying for yourself. Sessions and access are personal: they can't be shared, resold or transferred to someone else.
What you buy
- Early Bird Deal: one 40-minute 1:1 session, one 20-minute 40 44 Info Session and access to the 40 44 Workout Bank. It can be bought once per person.
- 1:1 Session: one 40-minute 1:1 coaching session.
- 8-Session Pack: eight 40-minute 1:1 coaching sessions. It can be bought twice per person.
Every coaching purchase also opens the 40 44 Workout Bank in your account. The Workout Bank isn't sold on its own.
Sessions are live 1:1 coaching by video call. The Workout Bank is digital content, released progressively: workouts are added over time, and what is in your account at any moment is what you have access to. Apps shown as "Coming soon" are previews, not something you can buy, and we can't promise when or whether they will launch.
Prices and payment
Prices are shown and charged in US dollars and include any tax we must charge. Your bank may add a currency conversion fee, which we don't control. Payment is taken in full when you check out, through Stripe; we never see or store your card details. Your order is accepted when the payment succeeds, and we confirm it on screen and by email.
If a price is shown wrongly by obvious mistake, we may cancel the order and refund you in full rather than sell at that price.
Booking your sessions
- After paying, you book through the links on your welcome page or in your account. Each booking is a request: we confirm it once we have matched it to your payment, usually within a day. A booking that doesn't match a payment is declined.
- Use every session within 12 months of buying it. Sessions not booked by then expire, unless we were the reason you couldn't book.
- To move or cancel a booked session, do it at least 24 hours before it starts, through your booking email or on WhatsApp. With less notice, or if you don't attend, the session counts as used. We will make a fair exception for genuine emergencies and illness.
- Sessions start and end on time. If you join late, the session still ends at its booked time.
- If we have to cancel or move a session, we will offer you another time, or refund that session if none suits you.
- Coaching messages run on WhatsApp. We reply within reasonable working hours; WhatsApp isn't an emergency service.
Your account and the Workout Bank
Your account opens with a one-time sign-in link sent to the email you paid with. Keep access to that inbox secure: anyone who can read it can sign in. Workout Bank access comes with your coaching purchase and is a personal, non-transferable licence for your own training. It lasts for as long as we run the Workout Bank, and ends if the purchase that gave it is refunded in full. If we ever close it, we will give at least 30 days' notice by email.
Our content
The workouts, videos, text, images and other content are ours or licensed to us, and are protected by copyright. You may use them for your own training. You may not copy, record, share, publish, resell or use them to train or build another product or service.
Results and testimonials
Training and diet results depend on your body, health, effort, sleep, consistency and many other things we don't control. Testimonials and examples show individual experiences, not typical or guaranteed results. We don't promise any particular outcome, such as weight lost, muscle gained or performance reached.
Equipment and affiliate links
Some equipment links are affiliate links: if you buy through them, we may earn a commission at no extra cost to you. We recommend only what we use, but those products are sold by the retailer, under its own terms, and any question about delivery, faults or returns goes to the retailer. Follow the manufacturer's instructions and safety guidance for any equipment you use.
Our responsibility to you
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law doesn't allow us to limit or exclude. Your statutory rights as a consumer are not affected.
Apart from that, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, for loss of profit, business or opportunity, or for loss caused by events outside our reasonable control, such as an outage at a payment, video, email or booking provider.
We are also not responsible for injury, illness or loss that results from you not following the health and safety notice below: training beyond your ability or against instructions, not telling us about a health condition, injury, pregnancy or medication, training without the medical clearance the notice asks for, training on your own from the Workout Bank without due care, or using an unsafe space or faulty equipment.
Where we are liable, our total liability for any purchase is limited to the price you paid for it, except where the law doesn't allow that limit.
Ending your access
We may suspend or end your access if you share it, copy or redistribute our content, behave abusively towards us, or reverse a payment while keeping what you bought. Where it is fair, we will refund unused sessions. You can ask us to close your account at any time.
Changes and the law
We may update these terms; the version at the time you buy applies to that purchase. These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you can also bring proceedings there, and if you live elsewhere you keep any mandatory protection your local law gives you. If a part of these terms is found unenforceable, the rest still applies.
Health and safety
Exercise and diet changes carry risk, including injury and, rarely, serious health events. Please read this before you train with us, book a session or follow any workout, diet or supplement guidance.
Not medical advice
We are coaches, not doctors, physiotherapists, registered dietitians or mental health professionals. Everything we share, in sessions, on WhatsApp, on this site or in the Workout Bank, is general fitness and lifestyle information. It is not medical advice, diagnosis or treatment, and it doesn't replace care from a qualified professional.
See a doctor first if
- you have, or have had, a heart condition, chest pain, high blood pressure, a stroke, or fainting or dizzy spells
- you have diabetes, asthma or another lung condition, epilepsy, or a joint, bone or back problem
- you are pregnant, may be pregnant, or have given birth in the last six months
- you have had surgery or an injury recently, or take medication that affects your heart rate, blood pressure or balance
- you have, or have had, an eating disorder
- you are new to exercise, returning after a long break, or over 65
- you are unsure in any way whether exercise is safe for you
Your part
- Tell us about any health condition, injury, pregnancy or medication before your first session, and tell us before any session if something has changed. We may adapt or postpone a session if we think it isn't safe to go ahead.
- Train within your ability. You can stop or skip any exercise at any time, and you are responsible for choosing to continue.
- Stop at once if you feel pain, chest pain or tightness, dizziness, unusual breathlessness, or feel unwell. In an emergency call 999 in the UK, 112 in the EU, or your local emergency number. Never wait to message us first.
- For video sessions and Workout Bank workouts you train in your own space, without a coach physically present. Make sure it is clear and safe, with a stable floor and enough room, that equipment is in good condition and set up as its maker instructs, and, ideally, that someone else is nearby.
Diet, supplements and the nutrient app
Diet and supplement information is general and is not tailored to medical needs. Check with a doctor or pharmacist before changing your diet or taking any supplement, especially if you are pregnant or breastfeeding, have a medical condition or allergy, or take medication. Calorie and nutrient figures, including those from any app we preview, are estimates. If food, weight or eating are causing you distress, please talk to your doctor or Beat (beateatingdisorders.org.uk).
Mindset content
Our mindset and discipline content is motivational, not therapy. If you are struggling or in crisis, contact your doctor, or call Samaritans free on 116 123 (UK and Ireland) at any time.
Cancellations and refunds
UK consumer law gives you 14 days from your purchase to change your mind. Here is how that works for what we sell, and what happens after.
Coaching sessions
- Within 14 days of buying, you can cancel for a full refund of any session that hasn't taken place.
- By booking a session that takes place within those 14 days, you ask us to start early. If you then cancel within the 14 days, we refund the price you paid minus a proportionate amount for the sessions already delivered. For the 8-Session Pack, each delivered session is priced at your pack rate, not the single-session price.
- Once all the sessions you bought have taken place, there is nothing left to cancel.
- After 14 days, purchases are not refundable for a change of mind. Unused sessions stay yours to book until they expire.
Workout Bank access
Workout Bank access comes with your coaching purchase and opens as soon as you pay: at checkout you ask for it to start straight away. Refunds are worked out on your sessions, and when a purchase is refunded in full, the Workout Bank access it gave ends. If the Workout Bank doesn't work as described, you still have your legal rights: tell us and we will fix it.
Early Bird Deal
Its 1:1 session and Info Session follow the coaching rules above. Cancel within 14 days and we refund the sessions that haven't taken place, valued in proportion to what you paid for the deal.
When we can't deliver
If we can't provide a session you paid for, because of illness or anything else on our side, and we can't offer a time that suits you, we refund that session in full, whenever that happens.
How to cancel
email train@4044method.com from the address you bought with, and tell us what you bought and that you want to cancel. You can use the wording: "I hereby give notice that I cancel my contract for the supply of the following service: [what you bought], bought on [date], [your name], [your email]." You don't have to give a reason.
Your refund
We refund to the card you paid with, within 14 days of your cancellation. Your bank may take a few more days to show it. When a purchase is refunded in full, the access and sessions it gave are removed from your account.
Before a chargeback
If something has gone wrong, please contact us first: we will sort it out quickly. A disputed payment pauses the access it paid for until the dispute is settled.
Privacy
Colas Taylor, trading as 40 44 Method is the controller of the personal data described here, under UK GDPR and the Data Protection Act 2018. For anything about your data, email train@4044method.com.
What we collect, and why
- Your email address and account: to create your account, send your sign-in links and receipts, and give you what you bought (to perform our contract with you).
- Your purchases: what you bought, when and for how much, from Stripe. We never receive your full card details. We keep these records to deliver your purchases and because tax law requires it.
- The goal you pick before checkout: to plan your sessions (contract).
- Bookings: your name, email, chosen times and any notes you add on Cal.com (contract).
- WhatsApp: your phone number and the messages you send us when you choose to contact us there (contract, and our legitimate interest in answering you).
- Health information you choose to share, such as injuries, conditions, pregnancy or medication: only to keep your training safe, and only with your explicit consent, which you give by sharing it and can withdraw at any time.
- Sign-in with Google, if you use it: your name and email from Google (contract).
- Technical data: IP address and browser details in security and server logs, used to keep the site secure and stop abuse (legitimate interests). Any site analytics we use are cookie-free and count visits without identifying you.
We don't sell your data, and we don't send you marketing emails unless you have asked for them.
Who we share it with
Only the providers that run the service for us, under contracts that protect your data: Stripe (payments), Supabase (accounts and database, hosted in Ireland), Resend (email, sent from the EU), Cloudflare (hosting and security), Cal.com (bookings), WhatsApp, run by Meta (messages, end-to-end encrypted), and Google (only if you sign in with Google). Some of them process data in the United States; those transfers are protected by the UK's adequacy regulations or the UK's approved transfer agreements. We also share data where the law requires it.
How long we keep it
- Purchase and payment records: 6 years, as UK tax law requires.
- Your account: while you use it, and up to 2 years after your last sign-in or session; then we delete it, or sooner if you ask.
- Health information and coaching messages: up to 12 months after your last session.
- Security logs: a short period, set by our hosting provider.
Your rights
You can ask to see the data we hold about you, correct it, delete it, restrict or object to how we use it, receive a copy to take elsewhere, and withdraw consent you have given. Email us and we will reply within one month. If you're unhappy with how we handle your data, you can complain to the Information Commissioner's Office (ico.org.uk, 0303 123 1113), though we would like the chance to put it right first.
Security and children
Data is encrypted in transit, access is restricted, and accounts sign in with one-time links instead of passwords that can leak. No system is perfectly secure, and we will tell you and the ICO if a breach puts you at risk. The service isn't for anyone under 18, and we don't knowingly collect their data.
